SPORTJOBS USER AGREEMENT
1. GENERAL
1.1 Introduction
Welcome to Sportjobs. This site is operated by Sportjobs Pty Ltd ("Sportjobs"). This User Agreement applies to any person (you) who uses this site. If you do not agree with any term of this User Agreement or the associated Privacy Policy, you should not use this service. 1.2 Site description
Sportjobs operates an Australian based website that promotes sports orientated employment opportunities, sports related business sales and sports related events.
1.3 Changes to these terms
In order to reflect our changing business and to accommodate future technological advances, we reserve the right to change or vary the terms of this User Agreement and Privacy Policy at any time by posting a notice on the homepage which states that the user terms have been updated.
2. ACCURACY AND USE OF INFORMATION
2.1 All information that you submit to Sportjobs must be accurate and not misleading.
2.2 You grant Sportjobs a non-exclusive, royalty free, perpetual licence to use, modify, reproduce, publish and otherwise deal with all information and material that you provide to us, in any manner that we consider appropriate.
2.3 If you provide personal information of any person to us, you warrant that that person has read the Privacy Policy and consents to such information being disclosed to Sportjobs and used by Sportjobs in accordance with the Privacy Policy.
3. USING THIS SERVICE
3.1 In order to list a sports related employment opportunity, sports related sale of business or a sports related event, you must read and agree to be bound by the Listing Conditions available at [include link].
3.2 As a user of this site, you agree that you will not:
(a) violate any laws or rights of third parties;
(b) distribute or post spam or attempt to publish any material that is not a sports related employment opportunity;
(c) distribute or post any computer virus or computer program of any kind that may harm or disrupt Sportjobs or the interests or property of any user of Sportjobs;
(d) post any profane or inappropriate material or comments on this site in any form whatsoever, including without limitation information or material that is offensive, obscene, threatening, inflammatory, indecent, pornographic, defamatory or confidential;
(e) collect information about other users without their consent; or
(f) use, reproduce, communicate, publish or distribute any content from this site, unless such use constitutes a fair dealing pursuant to the Copyright Act 1968 (Cth).
4. REPORT PROBLEMS OR VIOLATIONS TO US
We request that you report to us any offensive content posted on this site, or any conduct that you consider may be in breach of this User Agreement or Privacy Policy, at [insert email address and/or phone number]. Alternately, if you consider that your rights as a user have been violated, please contact us and we will conduct an investigation as we deem appropriate.
5. SUBSCRIBING TO SPORTJOBS MAILING LISTS
If you subscribe to the Sportjobs mailing list, you consent to Sportjobs sending you information (by email or otherwise) regarding this service or job opportunities that Sportjobs considers may be of interest to you.
6. DISPLAY OF EMPLOYEE'S CV
Employees will be given the opportunity to make their CV available online to prospective employees by selecting the "Publish CV" (“PUBLIC”) option that is contained in the Job Seeker login section of the site. Employers that register to use this site will then be able to view the CV (with the employee's name removed). Employers must purchase credits in order to view the employee's name. Prior to uploading their CV, employees should consider that their current employer may have access to this service. NO LONGER

7. DISPLAY OF INFORMATION
Positions that are advertised on this service are provided by Sportjobs on behalf of a person or entity that has agreed to be bound by the terms of this User Agreement. Sportjobs is under no obligation to verify information provided by any third party and does not warrant its accuracy.
8. DISPUTE RESOLUTION
Sportjobs reserves the right to refer at its discretion any dispute arising out of or in connection with this User Agreement or Privacy Policy to an arbitrator. You agree that the rulings of an independent arbitrator appointed pursuant to this clause will be binding upon the parties.
9. SUSPENSION FROM SPORTJOBS
Sportjobs reserves the right to cancel your subscription or limit or block your use and access to this site if we believe in our absolute discretion that you are in contravention of this User Agreement or Privacy Policy.
10. LIABILITY
10.1 No recommendation
Sportjobs does not recommend any position advertised through this service. You should obtain independent legal or financial advice as to the suitability of any role.
10.2 No warranty
Sportjobs will endeavour to provide this service with reasonable care and skill and to maintain access to the site (unless your use has been cancelled or suspended). However, access to the site may be interrupted by factors beyond our control, such as technical problems. As such, Sportjobs does not warrant that your access to this service will be continuous, fault free, uninterrupted or secure.
10.3 Limitation of liability
To the extent permitted by law:
(a) Sportjobs excludes all terms, conditions, warranties, inducements or representations whether express, implied, statutory or otherwise (but excluding the express terms of this agreement) and any other liability it may have to you under statute or at law (including negligence) relating to this service; and
(b) Sportjobs limits its liability under any condition or warranty that cannot be excluded to, at its option:
(i) supplying the service again; or
(ii) paying the cost of supplying the service again.
10.4 No consequential damages
You agree that Sportjobs is not liable for any special, incidental or consequential damages suffered by you in connection with this site or Sportjobs' services (however arising, including negligence).
10.5 Access outside Australia
Sportjobs does not warrant that this site complies with the laws of any jurisdiction outside Australia. If you access this site from outside Australia, you do so at your own risk.
10.6 Disputes with other users
If you have a dispute with another user or users of this site, you agree to release us, our affiliates, subsidiaries, parents, shareholders, directors, officers, employees, agents and representatives from all claims, demands and damages arising out of or in connection with any such dispute.
10.7 Indemnity
You agree to indemnify and hold Sportjobs (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from all claims, demands, proceedings, damages, costs and liabilities (including our legal costs on a full indemnity basis) caused or arising out of your breach of this User Agreement or your violation of any law or the rights of a third party.
10.8 Links to other websites
Sportjobs may provide links to third party websites including websites of employers that use this service. Sportjobs is not liable for any linked site or services or the information provided by any linked site.
11. NO AGENCY
Sportjobs and its users are independent contractors and these terms do not create an agency, partnership, joint venture or employment relationship of any kind.
12. GOVERNING LAW
This User Agreement and Privacy Policy are subject to and governed by the laws of Victoria, Australia and all related disputes shall be determined in Victorian Courts.
